Terms of Use

These terms are the agreement between you and Nightshore ("we", "us"), for use of the Nightshore app ("Nightshore"). Our full legal and contact details, including a postal address, are in the privacy policy. By using the app you accept these terms.

Your purchases are also subject to Apple's Licensed Application End User License Agreement, which governs your licence to use the app itself. These terms cover your use of the Nightshore service.

Nightshore is not medical care

Nightshore is a self-help tool. It is not medical or psychological advice, not a diagnosis, not treatment, and not a substitute for a qualified professional. The AI companion is not a therapist, doctor or counsellor, and its replies are generated by software. Nightshore is not a crisis service and is not monitored. Do not rely on Nightshore in place of professional care. If you are in danger or thinking of harming yourself, contact your local emergency services or a crisis line now — 988 in the US, the Samaritans on 116 123 in the UK and Ireland, or your local equivalent.

You must be 16 or over

Nightshore is an adult product: it discusses adult material and adult sex. You must be 16 or over to use it.

Your account

Your account is anonymous by default and tied to your device. If you do not link an email address, losing the device means losing your history — we have no way to identify you and restore it. You are responsible for keeping access to your device and to any email address you link.

Subscriptions

Nightshore offers an optional auto-renewing subscription. Payment is charged to your Apple ID at confirmation of purchase, and it renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel a subscription, and turn off auto-renew, in your Apple account settings. Prices vary by region and may change; you will be told before a change affects you. Refunds are handled by Apple under the App Store terms, not by us. The price, billing period and renewal terms in force are the ones shown to you in the app at the time of purchase.

Site blocking

If you turn on site blocking, it filters through a third party and is a deliberate speed bump rather than a security control. It can be switched off, it does not cover every network path, and it will not stop a determined attempt to get around it. Do not rely on it as your only safeguard. See the privacy policy for what the filtering provider receives.

Acceptable use

Do not use Nightshore unlawfully, attempt to break or probe its security, or try to extract other users' data. Do not use the AI companion to try to generate illegal material.

Content you write, and the community feed

What you write stays yours. You grant us only the permission needed to store and display it back to you and to operate the features you use. Anything you choose to publish to the community feed is visible to other people using Nightshore, and you grant us the permission needed to display it to them for as long as it is there.

There is no tolerance for objectionable content or abusive behaviour. Do not post anything that is harassing, hateful, threatening, sexually explicit, that identifies or targets another person, that promotes self-harm, or that is unlawful. Do not post anything designed to sell, recruit or solicit.

The app provides controls for reporting content, for blocking an author, and for removing anything you posted yourself. We may remove any content, and suspend or terminate access, where we consider these terms to have been breached — without notice where the breach is serious. You can also email support@nightshore.app about anything on the feed. We do not offer a guaranteed response time.

Availability

We aim to keep Nightshore working but do not guarantee uninterrupted or error-free service. Features may change or be withdrawn. Some parts of the app require a connection.

Disclaimers and liability

To the fullest extent permitted by law, Nightshore is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law we are not liable for indirect or consequential loss, for loss of data, or for any outcome of relying on the app in place of professional care. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud, and nothing here affects your statutory rights as a consumer.

Apple

This agreement is between you and us, not with Apple, and we — not Apple — are solely responsible for Nightshore and its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation. We are responsible for addressing any claim relating to Nightshore, including product liability, any failure to conform to legal requirements, and claims under consumer protection legislation, and for any third-party claim that Nightshore infringes intellectual property rights. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Ending these terms

You may stop using Nightshore at any time and delete your data from Settings → Delete my data. We may suspend or end your access for a serious or repeated breach of these terms.

Governing law

These terms are governed by the laws of England and Wales, and its courts have non-exclusive jurisdiction. This does not deprive you of the protection of mandatory consumer law where you live.

Changes

We may update these terms; the date above will change and material changes will be noted in the app. Continuing to use Nightshore after that means you accept the update.
